Terms and conditions

Shipper has agreed to the following Terms & Conditions for shipping :

APPLICABILITY – The provision set out and referred to in this non negotiable Air Waybill (AWB) shall apply to all modes of transportation and services provided by FASTEX LOGISTICS PVT. LTD.
This AWB is a contract between FASTEX LOGISTICS PVT. LTD., the shipper and the parties. The parties means and includes the shipper, sender and their representatives.
The AWB is issued strictly on the basis of information provided by the shipper and goods are booked as per details provided, the losses caused thereby, the shipper agrees to compensate against the same and in case the vehicle/shipment is detained / seized by the govt. authorities, the Shipper stands liable to pay the penalty, and charge the loss to FASTEX LOGISTICS PVT. LTD.) & clear the same.
The parties here under declare that shipment covered under this AWB does not contain any letter of credit documents, insurance policy, shares, debentures, legal notices & all confidential documents. Shippers shall have a right to general lien over all the shipments for the parties towards dues payable to FASTEX LOGISTICS PVT. LTD. and if the lien is not satisfied within 30 days, FASTEX LOGISTICS PVT. LTD., may dispose off the goods on unpaid amount.
All the bookings are subject to Force Majeure Clause, in case of any unforeseen incidence of riots, strikes, political disturbances, rains, floods, accidents, festivals, other natural calamities and any other event beyond control of FASTEX LOGISTICS PVT. LTD. including the routine and or sudden inspection conducted by any govt. agency. The same clause does not bind the operation of FASTEX LOGISTICS PVT. LTD. FASTEX LOGISTICS PVT. LTD. is not responsible for losses or consequential losses arising out of it.
Freight shall be paid by the shipper and or consignee in full at the time of booking or delivery (unless ﬁnancial arrangement exists). The charges specified herein or tariff and contractual terms and conditions agreed by and between the parties shall prevail.
It is clearly understood that vehicle have to be claimed within 90 days, shipper is solely responsible to collect the undelivered shipment within 7 days from the date of arrival of POD and also for the demise from the date of delivery.
In cases of loss of original papers FASTEX LOGISTICS PVT. LTD. shall act as a facilitator in obtaining duplicate set of papers. The parties are not be entitled to deduct / adjust/set off payment dues to FASTEX LOGISTICS PVT. LTD.
Unless speciﬁed otherwise, all goods are booked subject to owner risk. The shipper is advised to obtain insurance coverage for movement of his goods.
The shipper is responsible for providing material in transport worthy packing which can withstand hazards of multiple transshipment, prevent leakages, safeguard material against rain & moisture, heat and jerks. In any event of claim, subject to exceptions available under the law, FASTEX LOGISTICS PVT. LTD. will issue a certificate of fact (COF) only & will act as a facilitator in organizing insurance survey at shipper cost.
FASTEX LOGISTICS PVT. LTD. assumes no responsibility of and / or liability in case packing of the material is intact there is no remark for shortage, breakage, leakage, pilferage etc. Discrepancy in receipt is to be notiﬁed immediately through remarks on POD copy of the AWB & also through a shortage / damage letter to FASTEX LOGISTICS PVT. LTD. No claim shall be entertained, if intimation is not given within 24 hours of delivery.
Open delivery is not allowed. In case of damage to packing, open delivery will be offered in presence of company authorized representative.
No claim shall be entertained by FASTEX LOGISTICS PVT. LTD. unless and until all the dues payable to FASTEX LOGISTICS PVT. LTD. is cleared by parties, including statutory payments made by FASTEX LOGISTICS PVT. LTD. made on behalf of the parties is reimbursed.
Demurrage / warehousing / detention charges are applicable after 48 hours arrival of undelivered material / material not unloaded from vehicle. The charges are 0.1% of declared value or Rs.1 per day per day charged whichever is higher subject to minimum Rs.100 per shipment.
If the shipment is not accepted by the parties when tendered for delivery for any reason FASTEX LOGISTICS PVT. LTD. shall be entitled to send the shipment to unclaimed goods department to proceed with sale of shipment to realize any dues payable by parties by issuing prescribed notices.
Dimensional weight or Actual weight whichever is higher will be charged as charged weight.
The shipments are booked on door pick-up or door delivery basis or for consignee’s consignee located at ground floor. For locations above ground floor additional handling charges are applicable.
The terms and conditions stipulated in this AWB is in addition to other contractual terms agreed upon between FASTEX LOGISTICS PVT. LTD. and parties.
Any dispute or differences arising from this AWB shall be referred to an arbitrator FASTEX LOGISTICS PVT. LTD. shall be entitled to nominate a sole arbitrator to adjudicate the dispute. The venue for any arbitration, arising out of this AWB, FASTEX LOGISTICS PVT. LTD. shall initiate action legally before the Ahmedabad court alone and courts in Ahmedabad shall alone have exclusive jurisdiction to adjudicate in all claims.
